Ex-Infinity Ward heads Jason West and Vincent Zampella, will be taking on their former employer, Activision, in the courts three weeks later on 29 May.
The two former Infinity Ward president and CEO filed a lawsuit against Activision in 2010 claiming a breach of contract and wrongful dismissal after their positions were terminated, and later added two counts of fraud, although one was dismissed reports Game Informer.
Activision takes the stand the two were dismissed because of secret talks with EA with respect to setting up a new studio and a conspiracy to destroy the Call of Duty franchise.
The case includes 38 other current and former employees of the studio who allege they are owed unpaid bonuses and royalties.
